Cosy Cabins Terms and Conditions
1. About These Terms
These Terms & Conditions govern your use of the Cosy Cabins website (cosycabins.co.nz) and any quote, order, or building contract you enter into with Vision Projects 2022 Limited, trading as Cosy Cabins (NZBN 9429050731220, LBP BP100109) — referred to here as “Cosy Cabins”, “we”, “us” or “our”. By using this website or engaging our services, you agree to these Terms.
Where you enter into a specific building contract with us, the terms of that contract take precedence over these general Terms to the extent of any difference between them.
2. Our Services
Cosy Cabins designs, manufactures, and builds transportable cabins, tiny homes, granny flats, and custom-built spaces throughout New Zealand. Depending on the project, this may include:
- Transportable and modular builds constructed off-site at our Motueka facility and delivered to your property
- On-site builds constructed directly at your location
- Site preparation, foundations, and delivery coordination
- Building consent documentation and compliance with the Building Act 2004 and the Building Code
3. Quotes & Online Estimates
Prices shown through our online calculators and “Get Instant Price” tool are estimates provided to help you plan. Final pricing is confirmed after a site assessment that takes into account site access, ground conditions, consent requirements, and any customisations agreed with you.
An estimate becomes binding only once we provide you with a formal, itemised quote and you accept it. That formal quote is the point at which a contract is formed, and it is issued before any deposit is requested.
4. Orders, Deposits & Payment
- A deposit secures your project, allows us to finalise design drawings, and books production. It is payable on signing your building contract.
- Progress payments are then made at the agreed milestones set out in your contract, each falling due as that milestone is reached.
- We issue payment claims that comply with the Construction Contracts Act 2002. Payment is due within 7 working days of a compliant payment claim. If you intend to pay a different amount, you may issue a payment schedule that complies with that Act on or before the due date.
- Once manufacturing, material ordering, or custom work has commenced, deposits and progress payments reflect the labour, administration, and supplier costs already committed to your build, and are payable accordingly. 5. Building Consents & Compliance
Where a building consent is required, Cosy Cabins will manage the consent process on your behalf where we agree to do so; your contract records who is responsible for obtaining the building consent and Code Compliance Certificate for your project. All building work is carried out in accordance with the Building Act 2004, the Building Code, NZS 3604:2011 where applicable, and relevant New Zealand legislation, and is supervised by a Licensed Building Practitioner where required.
To let us plan and quote accurately, you agree to provide accurate information about your site, including access, services, ground conditions, and existing structures. Where site information you provide turns out to be inaccurate or incomplete, any resulting additional costs may be charged separately as a variation.
6. Delivery & Site Access
For transportable builds, delivery is arranged nationwide by insured transport and HIAB crane. You are responsible for providing safe, clear and adequate site access for delivery vehicles and, where applicable, crane equipment. Where site access requires additional work or equipment, additional costs may apply, or an on-site build may suit your site better — we will discuss the best option with you.
7. Warranty
Cosy Cabins provides warranty cover as set out in our Warranty Policy and your building contract, including:
- A 12-month defects liability period from Handover, during which we remedy any notified defect at our cost within a reasonable time.
- A 10-year performance guarantee on materials used in the build, where they are used and maintained in accordance with the manufacturer’s requirements.
Certain products and materials supplied as part of your build (appliances, roofing, cladding, and similar) may also carry separate manufacturer warranties, which we pass on to you where they can be assigned and which apply independently of our own.
Your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 always apply and remain fully protected. Where the works are residential building work, the implied warranties in sections 362I to 362K of the Building Act 2004 also apply.
8. Intellectual Property
Design concepts, plans, and drawings prepared by Cosy Cabins remain our intellectual property unless we agree otherwise in writing, including where a deposit has been paid. You may use them for your own project. Any other reproduction or use, including using them to build with another party, requires our written consent.
Where you supply designs or specifications to us, you confirm they respect the intellectual property rights of others, and you agree to cover us for any claim arising from our use of them.
9. Limitation of Liability
To the maximum extent the law allows:
- For any claim arising from a building project, our total liability is limited to the value of the contract for that project.
- For any claim arising from general use of this website, our total liability is limited to NZD $100.
- We are not liable for indirect or consequential loss, including loss of profit, loss of use, or loss of opportunity.
Nothing in this clause limits liability that cannot be limited at law, including under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or the Building Act 2004, or liability for personal injury or death.
10. Website Use
Content on this website, including text, images, and pricing tools, is provided to guide you alongside your formal quote and contract. We make reasonable efforts to keep pricing and cabin specifications accurate and current. Where you notice something that looks out of date, please contact us and we will confirm the current position.
11. Privacy
We collect and use your personal information to provide our services, prepare and follow up on quotes, assess creditworthiness, deliver your build, and enforce our rights, in accordance with the Privacy Act 2020. This includes information you provide through our website forms and online calculators, such as your name, contact details, and site information.
We may share your information with subcontractors, credit reporting agencies, or professional advisers where reasonably necessary to provide our services or where the law requires it, and we take reasonable steps to keep your information secure. You may ask to access or correct the information we hold about you at any time by contacting us using the details below. Full details are set out in our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. The current version is always available on this page. Where you continue to use our website or services after an update is published, that confirms your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by New Zealand law, and any disputes are subject to the jurisdiction of the New Zealand courts.
